EX WANTED TO MOVE OUT OF STATE WITHOUT INFORMATION

The orders passed by the court during our divorce were pretty clear.  The order said that my ex wife could have custody of our only son.  I had visitation rights every fortnight.  She was asked to stay in the matrimonial home that we had taken.  It therefore came as a surprise to me to know that my ex wanted to move out of state to Texas.  She had not told me anything about it.  I got to know from her neighbors that arrangements were underway to make the movement.

 

I confronted my ex wife with the information only to be thwarted and told that it was just a rumor.  Not wanting to take any chances I made further inquiries and confirmed the fact that she indeed intended to move out.  I knew that I had to do something about it and immediately contacted my lawyer about the same.

 

We had to move fast to get my ex wife to stop.  She was well prepared to make the move.  My lawyer took over from me immediately and sent out a letter to her reminding her about the orders from the court at the time of the divorce.  He got a reply from her lawyer’s office giving the information that this was only going to be a temporary move.  We had the evidence we wanted in our possession.  My lawyer did not hesitate to move the courts again asking for a stop on any movement of my ex wife out of the state with our son.

 

That in turn started another round of battles in the courts.  I did not want to loose my son and was insistent that my ex wife either remain in the state or hand over custody of our son to me.  It was only then that it was revealed that she intended to marry her old boyfriend living in Texas and was going to make the move there.

 

As matters were headed in the direction we wanted my lawyer did everything to push for a stay on her movement.  The pressure applied turned out to be good.  My ex wife had to forego custody of our son to me in return for allowing her to leave the state.  I had managed to get custody of my son with sufficient help from my lawyer.
